By accessing and using Contestit, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, you may not use our service.

2. Service Description

Contestit provides web-based giveaway creation and management tools. Our platform offers:

• Giveaway creation with customizable rules and requirements
• Participant entry system with gamification features (points, leaderboards, badges)
• Three winner selection methods: random, weighted by points, and top performers
• Email template generation for winner notifications
• Analytics and export tools for participant data
• Social media integration capabilities

What We Are NOT:

• A giveaway hosting service or legal compliance provider
• A prize fulfillment or delivery company
• A payment processor for prizes
• Responsible for creator-participant disputes

3. Subscription Plans and Billing

Available Plans:

Billing Terms:

• Automatic monthly recurring billing via Stripe
• Immediate access upon successful payment
• Cancellation applies to next billing cycle
• No prorated refunds for unused time
• All sales are final
• Pro plan includes 7-day free trial for new users

4. Giveaway Participation and Platform Use

You agree to use our service only for lawful purposes. You are prohibited from:

• Using the platform for illegal contests, gambling, or fraudulent activities
• Creating giveaways that violate platform policies or social media terms
• Attempting to manipulate winner selection algorithms or points systems
• Sharing login credentials or creating multiple accounts
• Using the platform to collect data for spam or unauthorized marketing
• Interfering with or disrupting the service

5. Creator Responsibilities and Legal Compliance

IMPORTANT: As a giveaway creator, you are solely responsible for the legal compliance and management of your giveaways. Contestit provides software tools only.

Legal Compliance (Creator's Sole Responsibility):

• Compliance with all applicable contest, sweepstakes, and giveaway laws
• Obtaining necessary permits, licenses, or registrations required by law
• Understanding and following federal, state, local, and international regulations
• Compliance with platform-specific terms (Instagram, TikTok, YouTube, etc.)
• Proper tax reporting and handling of prize-related obligations

Giveaway Management (Creator's Sole Responsibility):

• Creating clear, accurate, and legally compliant giveaway rules
• Defining eligibility requirements, entry methods, and prize details
• Verifying winner eligibility according to your stated rules
• Purchasing, obtaining, and delivering all promised prizes
• Contacting winners and managing all winner communications
• Handling prize claim deadlines and unclaimed prize policies
• Resolving any disputes with participants
• Maintaining records for legal and tax purposes

Platform Disclaimer:

We provide winner selection algorithms and notification templates, but each giveaway is created, managed, and fulfilled entirely by the individual creator. We are not a party to any giveaway and assume no responsibility for creator compliance with laws or prize fulfillment.

6. Account Responsibilities

You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Providing accurate and up-to-date information
• Notifying us immediately of any unauthorized use

5. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of Contestit and its licensors.

6. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, and hereby disclaim all other warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability and Platform Scope

Platform Liability Limits:

• Our liability is strictly limited to providing functional software tools
• We are not responsible for creator actions, legal compliance, or prize fulfillment
• We provide no warranties regarding giveaway outcomes or legal compliance
• Maximum liability limited to subscription fees paid in the last 12 months
• The platform is provided "as-is" without warranties of any kind

What We Are NOT Liable For:

• Prize delivery, fulfillment, or quality
• Creator compliance with contest or sweepstakes laws
• Participant eligibility verification
• Creator-participant disputes or communications
• Tax implications of prizes or giveaway activities
• Social media platform policy violations
• Legal issues arising from giveaway management

Exclusion of Damages:

In no event shall Contestit be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, regardless of the theory of liability.

8. Winner Notifications and Communications

Platform Role: We provide email template generation tools only. All winner contact and prize-related communications are the creator's responsibility.

Creator Responsibilities:

• Send winner notifications using your own email systems
• Maintain all contact with winners throughout the prize claim process
• Set and enforce prize claim deadlines and procedures
• Handle winner verification and eligibility confirmation
• Resolve any prize-related issues or disputes

Platform Limitations:

• We do not automatically contact winners or participants
• We do not verify winner eligibility or identity
• We do not mediate creator-participant disputes
• We do not track prize delivery or claim status

9. Account Termination

We reserve the right to terminate accounts for violations of these terms, fraudulent activity, or creating illegal/harmful giveaways.

Termination Grounds:

• Violation of these Terms of Service
• Fraudulent activity or payment disputes
• Creating illegal or harmful giveaways
• Abuse of platform features or other users
• Repeated creator responsibility violations

Upon Termination:

• Access to the platform will be immediately revoked
• Data may be retained for legal or technical reasons
• No refunds will be provided for remaining subscription time
• Users may request data export within 30 days

9. Changes to Terms

We reserve the right to modify or replace these terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
